1 – Propósito y comentarios generales
Estas condiciones generales regulan la compra de productos a través del sitio web: www.nutshop.bigcartel.com (en adelante denominado “Sitio web” o ” Portal “), propiedad de Nutcreatives, SL (en lo sucesivo, “Nutcreatives”), cuyo CIF es ESB65692014 y domicilio social en calle Laforja, 118 principal, 08021 Barcelona.
El uso de los servicios del Sitio Web, así como la adquisición de cualquiera de los productos ofrecidos por Nutcreatives en el Portal (en lo sucesivo, los “Productos” o “Producto”) , supone la aceptación sin reservas de cada uno de los puntos de estas condiciones generales. El registro en el Portal y el uso de los servicios comporta que los datos de los usuarios formen parte del archivo de Nutcreatives. Estos datos serán tratados de conformidad con lo dispuesto en la Política de privacidad, con respecto a los que el Usuario declara expresamente ser conocedor y aceptar.
Las presentes condiciones generales son las únicas condiciones aplicables al uso de Portal y para la compra de productos a través del mismo. Además, sustituye a otros términos y condiciones, a menos que se acuerde lo contrario por escrito previamente entre Nutcreatives y el Usuario. En consecuencia, los usuarios que accedan al sitio Web y compren productos en el Portal acuerdan someterse y estar sujetos a las condiciones generales.
2 – Información del producto
Las descripciones, fotografías, representaciones gráficas e icónicas y vídeos relacionados con los productos ofrecidos por Nutcreatives en el Portal, así como los nombres comerciales, marcas o signos distintivos de cualquier clase contenidos en el Sitio Web se utilizan con el fin de proporcionar toda la información necesaria. Nutcreatives se reserva el derecho a decidir los productos ofrecidos a los usuarios en el Portal en cada momento. Por otra parte, Nutcreatives se reserva el derecho de retirar, en cualquier momento y sin previo aviso, cualquiera de los productos ofrecidos a través del Portal.
3 – Productos de compra
Para comprar los productos, el usuario, mayor de edad, tiene que seleccionar el producto que desee adquirir y añadirlo a la cesta / pulsar el botón “Continuar”. El nombre del usuario , dirección de correo electrónico y la contraseña con el que Nutcreatives identifique al Usuario tienen carácter personal e intransferible.
Después de que el proceso de compra se haya completado, Nutcreatives enviará un mensaje de confirmación de recepción del pedido a la dirección de correo electrónico proporcionada por el usuario dentro de las veinticuatro ( 24 ) horas siguientes a la realización del pedido. Nutcreatives enviará al Usuario la factura correspondiente dentro de los treinta ( 30 ) días siguientes a la realización del pedido.
4 – Disponibilidad
Si como consecuencia de fuerza mayor , el producto no está disponible después de haber realizado la compra, Nutcreatives informará al usuario por e-mail de la cancelación parcial o total del pedido. La cancelación parcial de la orden no le otorga ningún derecho de cancelar toda la orden , sin perjuicio de la correspondiente derecho al usuario a retirarse de la compra , de conformidad con lo estipulado en las presentes Condiciones Generales.
5 – Precio del producto
Los precios de los productos que se ofrecen en el Sitio Web incluyen el IVA. Los gastos de envío del producto se enumeran y detallan en la sección titulada “check out” en el Sitio Web y serán pagados por el usuario .
Nutcreatives se reserva el derecho de modificar los precios indicados en el Sitio Web en cualquier momento. Los productos se facturarán al precio indicado en el Sitio Web en el momento del registro de la orden.
6 – Pago de los productos
El pago de los productos adquiridos y los gastos de envío , que serán detallados durante el proceso de compra, se puede hacer con sistema PayPal o por transferencia bancaria previo contacto vía mail con Nutcreatives.
Nutcreatives no tiene acceso a ninguna información bancaria de los usuarios. El Usuario deberá notificar a Nutcreatives de cualquier acusación ilegal o fraudulento de la cuenta utilizada para la compra de los productos ofrecidos en el Sitio Web enviando un correo electrónico a la siguiente dirección: [email protected] . Esto debe hacerse tan pronto como sea posible con el objetivo de permitir a Nutcreatives que adopte las medidas que considere oportunas .
7 – Orden de cancelación
El usuario puede proceder a cancelar su pedido antes de que se haya enviado por Nutcreatives. En caso de haber pagado, cuando se trata de la cancelación de la orden, Nutcreatives devolverá el importe pagado por el usuario tan pronto como sea posible y , en cualquier caso , no más tarde de treinta ( 30 ) días a partir de su cancelación.
8 – Entrega del producto
Nutcreatives se compromete a entregar los productos comprados por el Usuario en el proceso de compra lo más pronto posible, y cualquiera que sea el caso, dentro de los treinta ( 21 ) días naturales contados a partir de la fecha en que se realizó el pedido. La entrega se realizará en la dirección indicada a tal efecto durante el proceso de registro, o la dirección de entrega en el territorio indicado por el usuario durante el proceso de compra. Nutcreatives no será responsable de los errores o daños causados en la entrega a la dirección facilitada por el usuario no es la dirección deseada por el usuario en cuestión.
9 – Devolución de productos.
El usuario tendrá siete ( 7 ) días hábiles a partir de la entrega del producto par devolver el producto. En caso de devolver la compra de un producto, el usuario debe ponerse en contacto con Nutcreatives mediante el envío de un e -mail a la siguiente dirección : [email protected]
En cualquier caso, en caso devolver la compra, los siguientes requisitos deben cumplirse:
1 ) El producto debe estar en las mismas condiciones en que fue recibido y debe estar aún en su embalaje original y preservar su etiquetado .
2 ) Se debe utilizar la misma caja o sobre que se utilizó para la entrega, o en su defecto, en algún formato similar que garantice la devolución de los productos en perfectas condiciones.
3 ) Una copia de la factura de compra y el albarán de entrega del producto se debe incluir dentro del paquete, donde se indiquen los productos que se devuelven y los motivos para su devolución.
Las devoluciones de los pedidos deberán enviarse a la siguiente dirección Nutcreatives. Carrer Laforja 118 principal, 08021Barcelona ( España ). El usuario deberá pagar el costo de envío de retorno en caso de que ejerza su derecho a retirarse de la compra.
Sin perjuicio de cualquier otro derecho que pudiera corresponderles , los usuarios tienen derecho a un reembolso del precio de los productos defectuosos o productos que se entregan , pero que no corresponden a los pedidos. Al devolver los productos defectuosos a Nutcreatives , o los que no se corresponden con el pedido enviado, esto debe ser realizado por el usuario en la forma establecida en el apartado anterior, aunque en este caso, el usuario no tendrá que pagar la vuelta costes de envío para los productos en cuestión.
Siempre y cuando el usuario haya seguido el procedimiento establecido en el apartado anterior y haya cumplido con todos los requisitos establecidos en las presentes Condiciones Generales, Nutcreatives reembolsará el precio pagado por los productos devueltos.
Siempre y cuando el usuario haya seguido el procedimiento establecido en las Condiciones Generales y haya cumplido con todos los requisitos establecidos en el mismo, Nutcreatives reembolsará el precio pagado por el usuario correspondiente a los productos devueltos . En el caso de que la devolución se produzca de conformidad con el ejercicio del derecho del usuario a devolver la compra, Nutcreatives no pagarán los gastos de devolución.
El usuario no tendrá derecho a la devolución del precio de los productos devueltos “cuando estos no se encuentren en las mismas condiciones en que fuera recibido, o no se hayan cumplido los requisitos establecidos en las presentes Condiciones Generales”.
Nutcreatives gestionará el reembolso del precio mediante el mismo sistema utilizado por el usuario para pagar los productos. El plazo de devolución será de treinta ( 30 ) días a partir de la recogida del producto y después de que Nutcreatives haya comprobado que los productos en cuestión cumplen los requisitos establecidos en los apartados anteriores. La aplicación de la devolución de los precios en la cuenta del usuario dependerá del banco involucrado .
10 – Garantía del producto
El plazo de la garantía será de dos años, siempre y cuando se trate de desperfectos de origen del producto. En ningún caso cuando se deban a desperfectos por un mal uso del Usuario.
11 – Comunicación entre el usuario y Nutcreatives
Todas las comunicaciones entre Nutcreatives y el usuario respecto a estas Condiciones Generales, o la compra de productos a través del Sitio Web , se llevarán a cabo de conformidad con los procedimientos de comunicación establecidos en estas Condiciones Generales en cada caso particular. Para todas las demás circunstancias que no estén reguladas expresamente por las presentes Condiciones Generales, las comunicaciones que el usuario desea realizar con Nutcreatives se dirigirán por escrito y por medio de un sistema que permita la acreditación del contenido y de la recepción de la comunicación de que se trate por Nutcreatives .
12 – Integridad de las Condiciones Generales
Las presentes Condiciones Generales, la política de privacidad y el Aviso Legal representan la única y explícita intención de Nutcreatives y el Usuario como con respecto a su objeto y por la presente se anule y sustituya cualquier otro acuerdo o contrato , ya sea verbal o escrita, alcanzado entre las partes hasta ahora .
13 – Nulidad Parcial
En el caso de que cualquier cláusula de las presentes Condiciones Generales fuese declarada nula , se optará por modificarla o reemplazarla. En cualquier caso , toda declaración de nulidad no afectará a la validez del resto de las cláusulas estipuladas en las presentes Condiciones Generales.
14 – Jurisdicción
Las presentes Condiciones Generales se regirán e interpretarán de conformidad con la legislación española . En el caso de que cualquier disputa o reclamo que surgieran entre las partes sobre el cumplimiento o el contenido de las presentes Condiciones Generales, las partes se someterán a los Juzgados y Tribunales competentes de conformidad con la ley aplicable.
15 – Política de privacidad
De conformidad con lo dispuesto en la Ley 15/1999 española de Protección de Datos Personales , de 13 de diciembre (en adelante denominado el ” PDAA “) y su normativa de desarrollo, le informamos que los datos que nos ha proporcionado sobre el registro en la web , www.nutshop.bigcartel.com ( en lo sucesivo, el “Portal “) , así como los derivados de la relación comercial y / o entrega de los productos adquiridos sobre el mismo , se incluirán en el fichero de Nutcreatives , SL ( denominado en lo sucesivo ” Nutcreatives ” ). El Código Fiscal de Nutcreatives es : ESB65692014 , y domicilio social en la calle Laforja, 118 principal, 08021 Barcelona. La finalidad del tratamiento de estos datos es la comercialización de los productos ofrecidos por Nutcreatives en el Portal. A menos que se estipule lo contrario , todos los datos solicitados en el proceso de inscripción y los formularios disponibles en www.nutshop.bigcartel.com son obligatorios . Por lo tanto , la no realización de cualquiera de ellos puede hacer que sea imposible disponer de los servicios solicitados y / o responder a sus peticiones . Les pedimos a informar de cualquier modificación de sus datos inmediatamente para que la información contenida en nuestros ficheros esté al día en todo momento y no contenga ningún error.
A menos que se estipule lo contrario en el cuadro general habilitado al efecto durante el proceso de registro, el usuario otorga su consentimiento expreso para que sus datos para ser procesados por Nutcreatives con el propósito de enviar información comercial acerca de los productos comercializados por Nutcreatives y sobre las actividades y servicios que persigue Nutcreatives a través de correo convencional , correo electrónico , SMS o cualquier otro equivalente , los medios de comunicación electrónica , así como para permitir que los datos del Usuario a procesar para la segmentación y / o la elaboración de perfiles para la misma finalidad promocional o publicitario , aunque adaptado a su Nutcreatives servicios de perfil de usuario.
Usted puede ejercitar sus derechos de acceso , modificación, bloqueo y oponerse al tratamiento de sus datos en los términos y condiciones previstos en la ley, dirigiéndose por escrito dicha solicitud a la dirección anterior a la siguiente dirección de correo electrónico : [email protected] , acompañando a este tipo de comunicación con una fotocopia de su documento Nacional de Identidad o cualquier otro documento oficial que acredite su identidad.
Por último, le informamos que Nutcreatives deberán procesar sus datos de forma confidencial en todo momento y observando la obligación ineludible de secreto en relación misma , de conformidad con lo dispuesto en la normativa aplicable, para lo cual deberá adoptar todas las medidas técnicas y los medios necesarios para garantizar la seguridad de sus datos y evitar su alteración, pérdida, tratamiento o acceso no autorizado de organización, teniendo en cuenta el estado del arte de la tecnología , la naturaleza de los datos que han sido almacenados y los riesgos a los que se están expuestos .

1.- Purpose and general comments
These General Purchasing Terms and Conditions (hereinafter referred to as the “General Conditions”), along with any specific ones that may be laid down, regulate the purchase of products over the web site: www. www.nutshop.bigcartel.com (hereinafter referred to as the “Web Site” or the “Portal”), owned by Nutcreatives, S.L. (hereinafter referred to as “Nutcreatives”), the Tax Code No. of which is: B-65692014, and the registered business address of which is at Carrer Laforja 118 principal, 08021 Barcelona.
The use of the Web Site services, as well as the purchasing of any of the products offered by Nutcreatives over the Portal (hereinafter referred to as the “Products” or the “Product”), assumes the User’s unreserved acceptance of each one of these General Conditions. Registration on the Portal and the use of services brings with it User data forming part of the Nutcreatives files. These files shall be treated in accordance with that which is provided for in the Privacy Policy, with respect to which the User expressly declares himself or herself to be familiar and to accept.
These General Conditions are the only conditions that apply to Portal use and to the purchase of Products over same. Furthermore, they replace any other terms and conditions, unless otherwise previously agreed in writing between Nutcreatives and the User. Consequently, Users who access the Web Site and purchase Products over the Portal agree to subject themselves and be bound by the General Conditions as their wording stands when they access the Web Site.
2.- Product Information
The descriptions, photographs, graphic and iconic representations and videos related to the Products offered by Nutcreatives on the Portal, as well as trade names, brands or distinctive marks of any type contained on the Web Site are employed with a view to providing as much information as possible. Notwithstanding, the User must bear in mind that they are there merely as guidelines, and as such, lack comprehensiveness.
Nutcreatives reserves the right to decide the Products offered to users over the Portal at any given time.
Moreover, Nutcreatives reserves the right to leave off enabling access, at any given time and without prior notice, to any of the Products offered over the Portal.
3.- Purchasing Products
To purchase the Products, the registered User, who must be eighteen (18) year’s of age or over, has to select the Product he or she wishes to purchase and add it to the Shopping Basket/pressing the “CONTINUE” button.
The User name, e-mail address and password provided to Nutcreatives are identifying and enabling elements to access and make purchases and are personal and non-transferable.
After the purchasing process has been completed, Nutcreatives shall send an Order Reception confirmation message to the e-mail provided by the User within twenty-four (24) hours after the order has been placed. Nutcreatives shall send the User the corresponding invoice no later than thirty (30) days after the purchase has been made.
4.- Product Availability
If as a result of force majeure, a Product is not available after the purchase has been made, Nutcreatives shall inform the User by e-mail of the total, or where appropriate, partial cancellation of the order. The partial cancellation of the order does not grant any right to cancel the whole order, notwithstanding the right corresponding to the User to withdraw from the purchase in accordance with that which is stipulated in these General Conditions.
5.- Product Prices
The prices of the Products on offer over the Web Site include VAT and any other applicable taxes. Product shipment costs are listed and broken down in the section entitled “check out” on the Web Site and shall be paid for by the User.
Nutcreatives reserves the right to modify the prices indicated on the Web Site at any given moment. The Products shall be invoiced at the price indicated on the Web Site at the time of registering the order.
6.- Paying for Products
Payment for the Products purchased and shipment costs, which shall be detailed during the purchase process, can be made by PayPal system or bank transfer.
We hereby inform you that Nutcreatives shall not hold onto any Users’ bank details.
The User must notify Nutcreatives of any unlawful or fraudulent charge to the account used to purchase the Products offered on the Web Site by means by sending an e-mail to the following address: [email protected]. This should be done as soon as possible with the aim in mind of enabling Nutcreatives to take the measures it deems appropriate.
7.- Order Cancellation
The User can proceed to cancel his or her order before it has been shipped by Nutcreatives.
After aforementioned term has elapsed, the User cannot cancel the other, notwithstanding the exercise of the right to withdraw that corresponds to the User in accordance with that which is stipulated in these General Conditions.
In the event of having charged the User, when it comes to cancelling the order, Nutcreatives shall refund the amount paid by the User as soon as possible and, whatever the case, no later than thirty (30) days as of its cancellation.
8.- Product Delivery
Nutcreatives undertakes to deliver the products purchased by the User in the purchase process as soon as possible, and whatever the case, within thirty (30) calendar days as of the date on which the order was made. Delivery shall be made to the address indicated for this purpose during the registration process, or to the delivery address within the Territory indicated by the user during the purchase process.
Nutcreatives shall not be responsible for errors or damage caused when the delivery to the address provided by the User is not the address desired by the User in question.
9.- Returning Products
(i) Withdrawal right
The User shall have no more than seven (7) business days as of Product delivery to withdraw, totally or partially, from the purchase of same, in accordance with applicable legislation.
After the seven (7) business days term ends, Nutcreatives shall not accept returns as a result of wishing to withdraw from the purchase of Products.
In the event of withdrawing from the purchase of a Product, the User must contact Nutcreatives by means of sending an e-mail to the following address: [email protected]
Whatever the case, in the event of withdrawing from the purchase, the following requirements must be met:
1) The Product must in the same condition as when delivered and must still be in its original packaging and preserve its labelling.
2) Return to Nutcreatives must use the same box or envelope that was used for delivery, or failing this, in some similar format that ensures the return of the Products in perfect condition.
3) A copy of the purchase receipt and Product delivery note must be included inside the package, where indication must also be given indicating the Products being returned and the reason behind any such return.
Returns of orders must be sent to the following Nutcreatives address: Carrer Laforja 118 principal, 08021 Barcelona (Spain). The User shall pay for the return shipment costs in the event of exercising his or her right to withdraw from the purchase.
(ii) Return of faulty Products
Notwithstanding any other right that may correspond to them, Users have the right to a refund of the price of faulty Products or Products that are delivered but which do not correspond to the ones ordered.
When returning faulty Products to Nutcreatives, or ones that do not correspond to the order placed, this must be done by the User in the manner set forth in section (i) above, though in this case the User shall not have to pay the return shipment costs for the Products in question.
As long as the User has followed the procedure set forth in section (i) above and has met all the requirements laid down in these General Conditions, Nutcreatives shall refund the price paid for the Products returned, or for those that do not correspond to the order made by the User in accordance with that which is set forth in section (iii) below.
(iii) Refund of the Product price to the User
As long as the User has followed the procedure set forth in the General Conditions and has met all the requirements stipulated therein, Nutcreatives shall refund the price paid by the User corresponding to the Products returned. In the event that the return is brought about pursuant to the exercise of the User’s right to withdraw from the purchase according to section (i), Nutcreatives shall not pay any return costs and/or expenses.
The User shall not have any right to the refund of the returned Products’ price whenever these are found not to be in the same condition as when delivered, or the requirements set forth in these General Conditions have not been met.
Partial returns of an order shall result in the refund of the price paid for the Product or Products that have been returned.
Nutcreatives shall manage the price refund order by means of the same system used by the User to pay for the products, (Though pending confirmation, we believe that payments made by way of the Paypal platform shall be repaid in the same way, but in the case of credit/debit cards it shall be paid by bank transfer,… as we are not yet sure we shall confirm this with you in the course of the week). The term for refund shall be thirty (30) days as of the collection of the returned product and after Nutcreatives has checked that the products in question meet the requirements set forth in sections (i) and (ii) above. Application of the return of the prices into the User’s account shall depend on the bank involved.
10.- Product Guarantee
Some of the Products offered by Nutcreatives on the Web Site may be subject to a manufacturer’s guarantee.
In these cases, the Product purchased by the User shall be accompanied by a manufacturer’s information leaflet, sufficient instructions for the correct use and installation of the Product and all the information required about its guarantee.
The term of the guarantee shall be that which is specified by the manufacturer in the information leaflet accompanying the Product and shall become effective as of the date of the validation of the order by the User.
In the event of a breakdown or malfunction, Nutcreatives shall not be obliged to collect or repair the Product, thus the User must address any complaints to the Product manufacturer’s After-sales Service. In this sense, Nutcreatives can take the appropriate measures to supply Users who ask for them with the contact details of aforementioned service and to provide them with enough information to enable them to file the corresponding complaints.
11.- Communications between Nutcreatives and the User
All communications between Nutcreatives and the User concerning these General Conditions, or the purchase of Products over the Web Site, shall be conducted in accordance with the communication procedures set forth in these General Conditions for each particular case.
For all other circumstances that are not expressly regulated by these General Conditions, any communications that the User wishes to conduct with Nutcreatives shall be addressed in writing and by means of a system that enables the accrediting of the content and the reception of the communication in question by Nutcreatives.
12.- Integrity of the General Conditions
These General Conditions, the Privacy Policy and the Legal Notice represent the sole and explicit intention of Nutcreatives and the User as regard their subject matter and hereby annul and replace any other agreements or contracts, whether verbal or written, reached between the parties heretofore.
13.- Partial Nullity
In the event that any Clause to these General Conditions is declared null and void, it shall either be duly withdrawn or replaced. Whatever the case, any such declaration of nullity shall not affect the validity of the rest of the Clauses stipulated in these General Conditions.
14.- Jurisdiction
These General Conditions shall be governed by and interpreted in accordance with Spanish law.
In the event that any dispute or claim were to arise between the parties hereto concerning the fulfilment or contents of these General Conditions, the parties shall abide by the competent courts and tribunals in accordance with the applicable law.
15.- Privacy Policy
Pursuant to that which is provided for in the Spanish Personal Data Protection Act 15/1999 of 13 December (hereinafter referred to as the “PDAA”) and its developing regulations, we hereby inform you that the data you provided us on registering on the web, www.nutshop.bigcartel.com (hereinafter referred to as the “Portal”), as well as those arising from the business relationship and/or delivery of the products purchased over same, shall be included in a file for which Nutcreatives, S.L. (hereinafter referred to as “Nutcreatives”) is responsible. The Tax Code of the latter is: ESB65692014, while its registered address is at Carrer Laforja 118 principal, 08021 Barcelona. The purpose of processing this information is to market the products offered by Nutcreatives over the Portal, including the Customer Services’ Desk, to respond to queries and requests for information and to manage complaints.
Unless otherwise stipulated, all of the data that we request during the registration process and the forms available at www.nutshop.bigcartel.com are obligatory. Therefore, failure to complete any one of them may make it impossible for us to provide you with the services requested and/or respond to your requests. We would ask you to report any modification to your data to us immediately so that the information contained on our files is up-to-date at all times and does not contain any mistakes. In this sense, you hereby state that the information and data you have provided us with are accurate, current and true.
Unless otherwise stipulated in the box normally enabled for this purpose during the registration process, the User grants his or her express consent for his or her data to be processed by Nutcreatives for the purpose of sending him or her business information (including the e-newsletter) about the products marketed by Nutcreatives and about the activities and services pursued by Nutcreatives by way of conventional post, e-mail, SMS or any other equivalent, means of electronic communication, as well as to enable the User’s data to be processed for segmenting and/or to draw up profiles for the same promotional or advertising purpose, albeit adapted to his or her Nutcreatives services user profile.
You can exercise your right to access, alter, block and object to the treatment of your data under the terms and conditions provided for by law, by addressing in writing any such request to the above address or to the following e-mail address: [email protected], always accompanying any such communication with a photocopy of your National ID, or any other official document that accredits your identity.
Lastly, we hereby inform you that Nutcreatives shall process your data confidentially at all times and observing the mandatory obligation to secrecy as regards same, in accordance with that which is provided for in the applicable regulations, to which end it shall adopt all the technical and organisational means necessary to ensure the security of your data and to avoid their alteration, loss, processing or unauthorised access, bearing in mind the state of the art of the technology, the nature of the data that have been stored and the risks to which they are exposed.
